This site is owned and operated by Custom Portraits (also referred to in these terms as 'we', ‘us’ and 'our'). All content included on our site, such as artwork, photographs, illustrations, images, text (referred to as 'content') is owned by Custom Portraits or our content providers.

Custom Portraits is a trading name of the artist Pepito Junior Carlos (also referred to as ‘the artist’), Stratford, London E15.

Custom Portraits is providing this site on an ‘as is’ basis and makes no representations or warranties of any kind with respect to this site or its contents and disclaims all such representations and warranties.

You may not copy, reproduce, republish, download, post, broadcast, transmit or otherwise use the content in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from any content. Any other use of our content requires the prior written permission of Custom Portraits.

By sending pictures to us for Custom Portraits artwork, you warrant that you own the copyright of the original image or you have obtained the written permission of the copyright owner to use the photograph for the purpose stated.

You indemnify Custom Portraits against all legal fees, damages and other expenses that may be incurred by Custom Portraits as a result of your breach of the above warranty.

Pricing, Payment and Availability

All prices are correct at the time of entry. Prices stated in the site are fo UK customers only and are the total costs, including delivery charges.

Before any work commences on a commission, full payment will need to be made online and artwork will only begin once confirmed.

Orders are subject to the availability of the artist. In the unlikely event that the artist is unavailable, you will be notified as soon as possible. Price and availability information is subject to change without notice.

Proofs

As part of the Custom Portraits service, we will provide compositional and colour proofs/visuals to give you an idea of how the artwork is progressing, and also so you can customise the work to your own liking.

You may wish to make minor amends or request more options after viewing the initial proofs. However, because the work is meticulously drawn by hand, the amount and extent of any changes or additions remains at the discretion of the artist.

It is your responsibility to ensure that you reply promptly to the proofs given, so that the artist may continue with the artwork. Your order may be delayed if we do not receive feedback on the proofs in good time.

Delivery

We will commence work on your order as soon as your photograph and payment is received. Commissions will normally be completed and delivered within 2 to 3 weeks. Completion times are subject to the availability of the artist and your response times to the composition and colour proofs given as part of the Custom Portraits service.

Delivery will be made by Royal Mail 1st Class Recorded Delivery or by City Link for the next working day. Someone must be present to sign and collect the artwork. It is the sole responsibility of the customer to ensure that someone is available to take delivery and Custom Portraits cannot be held responsible for any late, lost or unforeseeable event caused by a delivery not being met. You shall be deemed to have accepted the goods 3 days after receiving delivery.

Please ensure that you check your delivery before signing for it. Custom Portraits will not accept liability for missing or damaged items unless this is brought to the attention of the delivery company. Please do not sign for your goods until you have physically checked them and are satisfied that they are in perfect condition.

Custom Portraits shall not be responsible for any loss or damage to your product during transport beyond the value of the invoice and what you have paid us.

Returns Policy

Due to the bespoke nature of Custom Portraits artwork, we are unable to offer you a refund or a cancellation once the order has been processed. This does not affect your statutory rights.

In the event of goods being damaged upon arrival you must advise the carriers and us immediately, and sign any delivery note stating that the goods are damaged. Alternatively please refuse delivery and contact us immediately.

Stretched prints are always quality checked before despatch. However, if a stretched print is faulty in any way on receipt, you can return it to us within 14 days. Please contact us first to clarify the returns procedure. We will review the fault and the production of a replacement remains at our sole discretion.

We will only acknowledge returned goods that are damaged or faulty if they are sent using Royal Mail Signed For Recorded or Special Delivery so there is proof of delivery.

If sending a printed photograph for us to work on, please send it using suitable reinforced packaging and by recorded delivery for security. However, we cannot accept responsibility for items lost or damaged in the post. Your photo will be returned with your canvas print when the order is complete.

Privacy Policy

Whilst Custom Portraits will need to take certain personal details such as contact and delivery information for orders, we will never pass this information over to any 3rd party (except for the needs of product delivery).

When you order, we ask for your telephone number and e-mail so that we may inform you of the status of the order, notify you of composition and colour proofs, or if there is a problem with your order.

The information that we hold about you, through orders and the contact page, may be used by us to contact you about any new products, services and special offers that may be of interest to you. If you do not wish us to use your information in this way please contact us.

Completed artworks may be made available for viewing to other users of this site for display in the Custom Portraits Gallery. You have the option to decline permission to do this at the stage of ordering.

By ordering from Custom Portraits, you agree to allow us to showcase or feature your work on other related web sites or in literature for promotional purposes. You have the option to decline permission to do this at the stage of ordering.

Access

While Custom Portraits endeavours to ensure that this site is normally available 24 hours a day, we shall not be liable if for any reason this site is unavailable at any time or for any period.

Access to this site may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond Custom Portraits’ control.

Framing/Linking

The Custom Portraits site contains links to other sites Web sites that may be of interest to you. However, we cannot be responsible for the privacy policies and practices of other web sites. We recommend that you check the policy of each site that you visit.

Any framing of or linking to this site is prohibited without the prior written permission of Custom Portraits.

Liability

Custom Portraits shall not be liable for any loss of income profits goodwill data contracts or any type of special indirect or consequential loss arising from the use inability to use or misuse of this site or any linked sites.

Custom Portraits does not warrant that this site or the server that makes it available are free of viruses or other harmful components.
